The government’s clarification today that in case of a sitting judge member of judicial commission being appointed as member of constitutional bench the next judge senior to him on constitutional bench will become a member of the powerful judicial commission that will appoint judges to superior courts also. Contrary to such a position taken in a press release issued by the Law Ministry the constitutional amendment draft duly notified states otherwise I.e it is not the next senior judge on the constitutional bench but a senior judge next to the three judges members of the commission.
